Victoria Rosales Speaks to Law360 on Copyright Cases to Watch in 2026

Victoria Rosales recently spoke to Law360 on the key copyright cases to watch in the new year, as the courts continue to set precedent on the definition of fair use as it relates to the use of copyrighted material in artificial intelligence development. 

One specific case to pay attention to in 2026 is between tech startup ROSS Intelligence and Thomson Reuters, which alleges that ROSS created an AI-backed legal research tool using copyrighted material from Thomson Reuters’ Westlaw platform. With the Third Circuit now appealing the lower court’s ruling, this would be monumental, given that it would be the first to weigh in on fair use in AI development. While this case does not involve generative AI, it will have the potential to inform fair use in future generative AI cases. Victoria shares with Law360, “Even though it’s not necessarily a generative AI case, it’s important to keep an eye on because I think it can serve as a bellwether for how other courts might perceive these kinds of uses.”
