Dale Nelson Weighs In on Fan Fiction and Fair Use in Law360
Dale Nelson was recently featured in the Law360 article, “The Legal Advocacy Behind Fan Fiction’s Biggest Site,” which explores how copyright law applies to fan-created works and examines the Organization for Transformative Works (OTW) and its advocacy for fair use and creative freedom. Over the past two decades, digital fandoms have expanded at an unprecedented rate. The fan fiction landscape, in particular, occupies a unique position that often toes the line between creativity and copyright infringement.
Dale offers insight into how intellectual property owners can thoughtfully navigate that space while respecting both artistic expression and legal boundaries. “I think for a lot of IP owners…it’s OK for fans to have fun with their properties, but it’s not OK for them to run a business with their properties, because that’s the purview of the IP owner,” she tells Law360.
