Dale Nelson and Victoria Rosales Pen Article on AI Tips for Documentary Filmmakers in IDA’s Documentary Magazine

Dale Nelson and Victoria Rosales recently authored a piece in the International Documentary Association’s Documentary Magazine offering advice for documentary filmmakers on how to use artificial intelligence ethically and effectively. The article, titled “Legal FAQ: AI Tips for U.S. Documentary Filmmakers,” delves into the most crucial elements for filmmakers to be aware of, including opting for generative AI models trained on licensed materials, understanding that AI elements of a film will not be covered by copyright, and looking to relevant state laws to make a digital replica of a film.

The article acknowledges the state legislations seeking to regulate the use of AI in the industry, as well as proposed federal legislations, including the “No AI FRAUD Act” and “NO FAKES Act,” encouraging filmmakers to familiarize themselves with these laws and their limitations. “Between state and federal legislation, new guild regulations, and external pressure from public criticism, the AI and entertainment space is in a constant state of flux,” Dale and Victoria write, adding that filmmakers need to balance creative use of the new technology against potential legal risks.
