Alex Yousefzadeh Discusses Clearance on the “Legal Vision” Podcast
Alex Yousefzadeh recently joined the “Legal Vision” podcast, where he spoke to host and filmmaker Damien Swaby in an episode entitled “Navigating Clearance in Entertainment.” In the episode, Alex and Damien delve into the role of clearance in production cycles, the proper ways to ensure a product is legally permissible, and the differences between types of copyright clearances.
Drawing upon personal experiences with the Firm’s clients, Alex shares that filmmakers are often pleasantly surprised to find they hold more rights than they may have initially thought. “Clearance is pretty vast. It takes everything into account – from chain of title, to getting proper permissions in place to use music, images, and clips. It also considers bringing certain materials under fair use parameters, should they comply with the fair use factors,” Alex explains.
Alex goes on to outline the parameters that filmmakers should be aware of when portraying a product in their film in order to ensure it is legally permissible. “You can’t misuse the product – you would have to show it in its natural setting and use it for its intended purpose,” he tells Damien. Alex continues to expand upon the most effective practices for filmmakers to secure a clearance, providing nuanced and practical advice for listeners.
